These Terms and Conditions ("Terms") govern your download, access, and use of the Messages SMS - Phone Call mobile application (package name: `messages.chatsms.freechatmsg`, hereby referred to as the "Application") developed and provided by Messages SMS Text Messenger ("Service Provider", "we", "us", or "our").
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not install or use the Application.

1. Description of Service
Messages SMS - Phone Call is a communication utility application that enables users to send, receive, categorize, schedule, archive, block, and back up SMS/MMS messages, protect conversations in a local PIN-locked Secret Vault, make phone calls via a built-in Dialpad, view Recent Call logs, identify callers via Caller ID, and access quick post-call actions via the After-Call screen.

2. Default Handler Role & Carrier Charges
Default SMS / Calling Functionality: Certain core features of the Application (such as sending/receiving SMS/MMS, blocking messages, or managing call logs) require you to set the Application as your device's Default SMS Handler or grant specific runtime permissions.
Mobile Carrier Fees: Sending SMS/MMS messages and placing phone calls through the Application utilizes your mobile network operator's cellular service. Standard carrier messaging rates, voice call tariffs, and mobile data charges (including roaming charges outside your home region) apply according to your mobile service plan. You are solely responsible for all carrier fees incurred while using the Application.
Emergency Calls: While the Application includes a dialpad for convenience, it is not a replacement for your device's native emergency calling system. In the event of an emergency, always use your device's built-in emergency dialer if the Application is unavailable.

3. User Responsibilities: Secret Vault, Backups & Scheduled Messages
Secret Vault PIN Responsibility: The Secret Vault feature locks selected conversations locally on your device using a PIN chosen by you. Because we do not store your PIN or messages on external servers, we cannot recover your PIN or restore locked messages if you forget your passcode, clear the Application's storage, or lose your device.
Local Backups: The Backup & Restore tool generates local backup files of your messages. You are solely responsible for safeguarding your backup files and verifying that backups are completed before resetting your device, switching phones, or uninstalling the Application.
Scheduled SMS Delivery: Scheduled messages rely on your device being powered on, having active cellular signal/SIM credit, and permitting exact alarms (`SCHEDULE_EXACT_ALARM`). The Service Provider is not liable for delayed or undelivered scheduled messages caused by device battery depletion, OS battery-optimization restrictions, airplane mode, or carrier network outages.

4. Intellectual Property Rights
The Application, including its source code, UI/UX design, graphics, icons, Secret Vault architecture, and trademarks, is the exclusive property of Messages SMS Text Messenger and is protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial use on a compatible Android device.
You agree not to:
* Copy, modify, distribute, sell, or lease any part of the Application.
* Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Application.
* Remove, alter, or obscure any copyright, trademark, or proprietary notices.
* Use the Application to send bulk unsolicited spam SMS, phishing links ("smishing"), or unlawful communications.

5. Advertisements and In-App Purchases
Advertisements: The Application is offered as a free-to-download service supported by third-party advertisements (served via Google AdMob and mediation partners). By using the free version of the Application, you consent to the display of banner, native, interstitial, or app-open advertisements, including on the After-Call screen.
In-App Purchases / Subscriptions: The Application may offer optional paid features or ad-removal upgrades processed through Google Play Billing (`com.android.billingclient:billing`). All billing, renewals, cancellations, and refund requests are governed by the Google Play Terms of Service and managed directly through your Google Play Store account settings.

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by applicable law, Messages SMS Text Messenger shall not be held liable for any direct, indirect, incidental, consequential, or special damages—including but not limited to loss of SMS/MMS messages, missed calls, failed scheduled messages, corrupted backups, or data charges—arising out of your use or inability to use the Application.
